1. General provisions

1.1. These Terms of Service (hereinafter referred to as the "Agreement") govern the use of the HistoGames website (hereinafter referred to as the "Service"), located at histo.games.

1.2. The Service is an information aggregator of digital game prices from various online stores and provides users with:

  • Price comparison from different sources
  • Price history
  • Discount notifications (with subscription)
  • Analytics and statistics

1.3. By using the Service, you fully and unconditionally accept the terms of this Agreement. If you do not agree with any provision, stop using the Service.

1.4. The Service Administration reserves the right to change this Agreement without prior notice. The new version takes effect upon publication.

2. Informational nature of the Service

IMPORTANT: The Service is an information aggregator and is NOT an online store.

  • We do NOT process payments
  • We do NOT provide keys or game access
  • We are NOT affiliated with the stores listed on the Service and have no official partnerships with them, unless explicitly stated

2.2. Timeliness of prices and data

2.2.1. Information about prices, discounts, and game availability is obtained through automatic data collection (parsing) from publicly available sources (Steam, Epic Games Store, GOG, etc.).

2.2.2. We DO NOT guarantee:

  • ✗ Real-time price accuracy
  • ✗ Correct discount information
  • ✗ Game availability in store
  • ✗ Game availability in your region
  • ✗ Metadata accuracy (descriptions, images, ratings)

2.2.3. Data update delays:

  • Price updates occur periodically (usually every 30-60 minutes)
  • Technical failures may cause outdated data
  • Store prices may change before updating on our Service

2.2.4. Before purchase you must:

  • ✓ Check current price on store website
  • ✓ Familiarize yourself with sale conditions
  • ✓ Verify game availability
  • ✓ Check regional availability

2.3. Discount notifications

2.3.1. The Service may send discount notifications to users who subscribed to this feature.

2.3.2. We DO NOT guarantee:

  • ✗ Receiving notification for every discount
  • ✗ Timeliness of notifications
  • ✗ Absence of false positives

2.3.3. Reasons for missing notifications:

  • Parser technical failures
  • Data update delays
  • Short-term discounts (flash sales)
  • Errors in source data
  • Email/push notification delivery problems

2.3.4. User agrees that:

  • The Service is NOT liable for missed discounts
  • You CANNOT make claims for unreceived notifications
  • Notifications are provided on an "as-is" basis

3. Registration and account

3.1. Some features (discount subscription, view history, favorites) require registration.

3.2. Upon registration you undertake to:

  • Provide accurate information
  • Ensure password confidentiality
  • Immediately notify us of unauthorized access

3.3. We reserve the right to:

  • Reject registration
  • Block account without explanation
  • Delete accounts violating the Agreement

3.4. Account deletion:

  • You can delete your account at any time through profile settings
  • Account deletion will result in irreversible deletion of related data (favorites, view history, notification settings)
  • Data we are required to keep by law (payment records, tax reporting) will be retained for the established period

4. User content (reviews, comments, ratings)

4.1. For the future: If the Service adds review, comment, or rating functionality:

  • It is prohibited to post content that:

  • Copyright to your content remains with you

5. Subscription and paid services

5.1. The Service may offer paid features (Premium subscription):

  • Extended price history
  • Priority notifications
  • Analytics and charts
  • No advertising

5.2. Payment terms:

  • Payment is made through third-party payment systems
  • Subscription is renewed automatically (if not canceled)
  • Refunds are possible in accordance with section 11

5.3. We DO NOT guarantee:

  • Uninterrupted operation of paid features
  • Absence of technical failures
  • Preservation of current rates (prices may change)

5.4. Taxes (VAT):

  • Subscription prices are indicated excluding VAT (if applicable)
  • When paying in the European Union, tax may be added depending on user's country
  • Final payment amount will be shown on checkout page

5.5. Subscription price changes:

  • We may change subscription prices
  • You will be notified of any price changes at least 14 days in advance
  • Changes do not affect current paid period

6. Using the Service

6.1. Permitted use

You may:

You MAY NOT:

  • ✗ Use Service for illegal activities
  • ✗ Bypass technical restrictions (rate limits)
  • ✗ Impersonate Service staff

6.3. Violating these rules results in immediate account blocking.

7. Intellectual property

7.1. Our content:

  • Site design, logos, code belong to us
  • Copying without written permission is prohibited

7.2. Third-party content:

  • Game names, covers, descriptions belong to rights holders
  • We use them for informational purposes (fair use)
  • We do NOT claim copyright

7.3. Trademarks and logos:

  • All trademarks, logos, and game images are property of respective rights holders
  • They are used exclusively for informational purposes and product identification
  • Use of trademarks does NOT imply endorsement or partnership with their owners

8.3. By following a link, you leave our Service and act at your own risk.

9. Affiliate programs

9.1. The Service may participate in store affiliate programs (affiliate links).

9.2. Upon purchase through our link, we may receive a commission from the store.

9.3. This does NOT affect the price for you and does NOT affect our store ranking.

10. Limitation of liability

10.1. General limitation

The Service is provided "AS-IS" without any warranties.

We are NOT liable for:

  • ✗ Incorrect price and discount data
  • ✗ Missed notifications
  • ✗ Losses from purchases at outdated prices
  • ✗ Technical failures and Service unavailability
  • ✗ Account data loss
  • ✗ Third-party actions (stores)
  • ✗ Data from third-party APIs and open sources

Important: Information may come from third-party APIs, website parsing, and other open sources. We do NOT control their content, accuracy, and timeliness.

10.2. Maximum liability

In any case, our liability is limited to the amount you paid for subscription in the last 3 months, but not more than $100 USD.

10.3. Exceptions

Limitation of liability does NOT apply to:

  • Intentional harm
  • Violations prohibited by law

11. Refunds

11.1. For paid subscription:

  • Refund is possible within 14 days from payment date
  • Only if you have NOT used paid features
  • Refund through same payment system

11.2. Refund denial:

  • After 14 days from payment date
  • If you used paid features
  • Upon Agreement terms violation

12. Service changes and termination

12.1. We reserve the right to:

  • Change Service functionality
  • Discontinue support for individual features
  • Completely shut down the Service

12.2. Notification:

  • For significant changes — 30 days in advance
  • For Service closure — 60 days in advance

12.3. In case of closure:

  • Unused subscription is refunded proportionally
  • All user personal data will be deleted or anonymized in accordance with Privacy Policy and GDPR requirements
  • You can request a copy of your data before Service closure

13. Applicable law and dispute resolution

13.1. This Agreement is governed by the laws of Spain.

13.2. All disputes are resolved through negotiations.

13.3. If no agreement is reached — in court at the location of Service Administration.

15. Final provisions

15.1. If any provision of the Agreement is deemed invalid, the remaining provisions remain in force.

15.2. Administration's inaction in case of Agreement violation does NOT constitute waiver of rights.

15.3. This Agreement constitutes the complete agreement between you and the Service.

By using the Service, you confirm that:

  • ✓ You agree to all terms
  • ✓ You have reached 18 years of age (or 13+ with parental consent)
  • ✓ You will not make unreasonable claims
